I'm in same boat, upgraded to PP on June 1. your new status of I140 will be "We received request for PP".
For H1's Ext its the same receipt number . I think for 140 it will be the same .I subscribed to the notification of case status and i received an update oon the case saying the Premium processing requested for the petition

Hi,
I am currently in India.

AP expires on August 10th 2010. Applied for AP extension since April 30th 2010. My AP extension hasn't arrived yet.
Question:
There is no way I can travel back to US before August 10th. As per what I heard, a newly issued AP cannot be used to reenter the U.S. if it was not valid as of the date of departure form the U.S. IS this correct?

Thats not true. There are equal number of people who have EAD and still keep their H1 for some reason.

I know this issue have been discussed several times before, but I am trying to get practical answers from Guru's.
About to apply for my Canadian PR next week and my current status is
H1B (1.5 Years Left) and US GC Status : EB-2 (India) (Aug 2006), I-140 Approved , but havent filed for I-485 yet. As one could imagine Canadian PR is just a backup and I want to understand risks and potential issues in future.
1) Does appying/getting a Canadian PR before fling I-485 a issue? I know lot of folks did it , but was trying to see how you handled the issue at 485 Stage.
2) Although, I am not expecting my I-485 dates will be current very soon, what happens in case if I apply for 485 and Canadian PR is approved.
3) Can USCIS reject your I485 process if it sees canadian PR or do they send a RFE ?? I can always say that I will forgo my canadian PR once I get US GC , but do they buy it or would they make a issue out of it.

thanks! but one more thing is that I don't have H-4 approval notice/petition; but I have I-94 valid till 2009. Will this do for H1 approval????
Looks like your Husband got H1-B extension till 2009; per my knowledge you should have file I-539 along with your husband to get your H4 approval till 2009, if you didn't do it then looks like you need to do right away..or consult your attorney ASAP, I-94 card is doesn't validate your H4 status...
I am NOT a Lawyer; you many consult lawyer...this type of mistake my friend's did in past...

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

If this is true then some of the concurrent filers will try to upgrade them to PP.I will be surprised if they do that. But crazier things have happened.
I really doubt it, with all the current workload, USCIS can't take I-140 PP. That will further slow down the receipts.They have enough work for this year. Providing receipts, EAD, AP etc for more than 100,000 applicants.

If it is new 485 filing then you don't have A#.
A# on I-140 is nothing do with your 485.

Just to be clear - where were you born? India or Britain? You can be a British citizen, but if you were not born there, you are counted under the chargeable area of India, not ROW.
There really is no "priveledge" that you will recieve, if you were born in the UK. As Roseball mentions, if you are ROW and can file EB2, your dates would be current when it comes time to apply for I145. If you file EB3, you'll be (currently) stuck in Retrogression at I145 stage.
FWIW - you need to maintain status in the US to retain your greencard.

I am new to IV. I am just wondering whether we have ever emphasized on bifurcation of Immigration Bill or call for a interim law to facilitate legal immigrant's issues ( mainly retro victims) -
Our problems are very basic and do not have sociopolitical or economical strings attached to it (Probably works better for economy as lot of us are holding on to buy houses and other big budget stuff).
The main issue I have is
- Unable to change jobs
I can wait for GC but not being able to change jobs is hurting me most.
Employers do not find projects and do not pay on bench. Once you find a project Employer wants a big cut. All in the name of policy ;) .
Please share your thoughts.

Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?
Firstly, very sorry for your situation. Seems to be very tricky. I am no lawyer so take my .2 cents with a pinch of salt. I think you are intertwining two separate issues. FMLA may protect you during maternity leave (you need to read the act to see if you qualify) BUT USCIS not approving your petition has nothing to do with your pregnancy neither does your employer. Your employer can terminate you on the basis of non-approval of your H1 not that he is doing because of your pregnancy.

My situation is like this:
I have 3 months left in my 6th year of H1B. LC and I-140 got approved and presently my employer has filed for an extension of H1B for 3 years.
Once I get the 3-year extension, can I change jobs? I understand that my GC process resets, and I am ok with that. I am planning to get the H1B (valid for another 3 years) transferred to the new employer and would join them only after they get the I-797 (with 3 year validity)
If my present employer revokes I-140, can I legally stay in the country on the 3-yr H1B (new employer)? Or do I lose my status and have to immediately exit the country? I am not worried about retaining my PD.
Could you pls share your experiences in this and I would request suggestion on this. Request your help.
