Contract terms require "consideration" from both parties to be legally binding. Consideration is something you provide to the other party (i.e., money from you, data services from your carrier).
What consideration are the carriers offering you for tethering? You're already paying $X for Y GB of data used on your phone. It doesn't matter to the carrier if your Netflix app is using it, or your tethering app is sending the data to your laptop. Nothing changes on their end, they just send the data that you've already paid for to your phone, and your phone handles the rest.
You're right, it is black and white. It's a scam aimed at exploiting consumers like yourself who don't know any better, with an illegal contract term. I hope this goes to court soon, before the carriers in Canada (where I am) try to pull the same BS.

If you start hooking up the whole neighborhood through your home Internet connection, they would be well within their rights to charge you more money.

Does this mean we won't be seeing iTunes 7.0? I mean if they were releasing a new iTunes wouldn't they make the changes on the new release?
They would have to update the store to handle it as well. I would assume that there will be a new iTunes out today also and that the movie portion of the store wouldn't be backwards compatible.

Apple certainly had the First Mover's Advantage for a few of their products. But there are so many other company's that have come out with really innovative products like Asus, Motorola. Some of them have been innovative in terms of design while others in terms of tech used.

well no, i think that's a bad idea. software has to be pressed on both formats - expensive - prices will increase (not only in the software branch - two holy expensive drives in one mac?)

Also, in regards to stupid employees and sleazy mangers, yeah, they do exist. But more employees know their stuff than you might think. And there are quite a few managers who actually do care about trying to do a good job and help the customer.
Now on the other hand, sleazy managers and supervisors can screw so much of this up. While most of the employees aren't making a career out of working at Best Buy, the sups and managers typically are on some level at least, and it takes a certain, umm, level of person to get, err, stuck, yes, at that level if you know what I mean. There's a lot of inconsistency in these types of people. If you get good ones though, they tend to hire good employees and foster a good environment for customers. My store has good management. It's the only thing that makes it remotely tolerable to me.
This is true of any retail. And it doesn't matter how bad or good corporate itself is, if you have good managers they can make a store that is great to go to regardless of bad corporate culture or vice versa.
I'm sure Best Buy has some stores run by good management. I am betting the place you work at is one of those. But in my experiences amongst four different Best Buys between two different states, they are not the norm.
(and yes, working for good managers makes a helluva lot of difference. They really do set the tone and not just in how they treat you and the customers and expect you to treat the customers, but it also shows in the quality of help they hire or the quality of help they keep. ...the more I think about it, the more I don't see why iTunes wouldn't play the compatible Fairplay songs. Apple can't make any major changes to the existing DRM in files to break compatible Fairplay files.... since they would have then have to reencode all of those files sitting on people's hard drives.

Reality check, bought World at War - i didnt play it for more than 1hour
bought Modern Warfare 2 - played for about 1.5 hours
Now i'm tempted to pick this up even though I havent finished any of those others simply because the game supports stereoscopic 3D...

I for one will be staying with AT&T if and when Verizon gets the iPhone. I'll also be laughing while Verizon suffers the same fate that AT&T did as millions of users hit their network at once. I don't care how "strong" Verizon's network is, I don't think they're ready for the heavy hit they're going to take.
The situation is completely different for VZW than it was for ATT.
Firstly AT&T was the only network provider for the iPhone, this won't be the case for VZW. Secondly AT&T was at the very initial stages of 3G deployment with only a single channel deployed on 1900mhz compared to VZW using their entire spectrum for one network set. AT&T at the time was only using (and still is for the most part) a fraction of their spectrum for 3G.
Though this is Apple's first time messing with a CDMA radio, I wonder how bad they will screw it up? lol.

What if after pressing the start button, you create a timer and start it. Then pressing the cancel button invalidates and releases it. Then pressing the start button would create another timer, using the same pointer.
Totally untested and probably broken code below, but should demonstrate the idea:

if (myTimer!=nil) { // if the pointer already points to a timer, you don't want to create a second one without stoping and destroying the first

I posted a story to digg (http://www.digg.com/apple/MacRumors_spoils_keynote_for_watchers_on_their_spoiler_free_page) regarding the spoiling issue. I think Arn was extremely responsive to the issue and avoiding these kinds of inadvertent spoiling is difficult to do in this day and age. My brother even txted me a spoiler. Is it possible to be completely unspoiled regarding something like this?
There is no spoiling information so far in the story, but I imagine most of us are avoiding digg like the plague.
I mean that's great, but a bit of foresight would be better. I don't understand why a simple, non-postable page or thread could not be dedicated to just one simple link. That's the irritating point. Couple that with the people who posted spoilers on a thread dedicated to not spoiling the event for those of us who brought up the idea and were interested in it and it just kind of sucks to have people who have no concern for anyone else or the reasoning to stop for a second and ask should I really post what I am about to.

I am not sure if the pricing reported earlier for the videos is correct, but I did want to comment on one thing...
If the pricing IS correct ($9.99 for iPod version, $14.99 for TV version, $19.99 for both) then the movie studios who didn't sign on because they didn't feel those prices were fair can go and "F" themselves. :)
Essentially $20 bucks for 2 electronic versions with no DVD packaging, manufacturing and shipping to deal with could make a lot of money for the studios. To say that price is "not good enough" on their behalf just smacks of greed.
Whether $20 a pop is a good price for the consumer is debatable...it depends on their tech level. Those of us reading these forums mostly would rather go buy a new DVD in the store for $20 and then rip it ourselves for our own use. But many others don't want to be bothered, and would be happy to have pre-ripped versions for download and avoid ammassing an even larger collection of DVD boxes taking up space in their bookshelves.
Just like with new Mac computer releases...Apple comes up with options designed for the entire base they plan to sell to, not solely based on "power-user" needs/desires. $20 a pop is NOT "too expensive" for pricing for many...it's not a DISCOUNTED price, but it's a fair price and if the movies need to sell for $20 to get all the studios on board (in the future, if not now), that is more important than trying to be an uber-discount movie sales site.

Same here. They can keep the iPhone 4 design for years and years. I love it. As far as a bigger screen, i don't really care either way. Give me dual-core A5, doubled RAM, and 64 GB, a better camera sensor, and i'm happy. I don't want 8 MP camera, just a 5 MP camera with a bigger/better sensor. :)
Bigger sensor requires bigger lens and bigger lens requires bigger housing. With Apple, you are not going to get this. If you look for bigger sensor -check Nokia or Sony phones.

well here's something weird going on. when i stand my computer up, the temps go up. and when i lay it down, they go back down. here is a youtube video of it. (http://www.youtube.com/watch?v=ZXCSPXOOZ5U)
but i do have a theory. the only thing i can think of is the cpu cooler isn't air tight, even though i screwed it as tight as i could. oh well, i guess i'll check it laid down
