Hi guys,
I sent in the four letters 2 weeks ago and this week I got a mail from TEXAS Service Center. They returned my letter in original and they also wrote a big one page letter.
I don't have it with me right now but in it, it was mentioned that "Please call us at our inquiry center if you have any inquires or you can check your status online as well as the recent processing times.
Don't know if others are also receiving the same returned mail but I wanted to let you guys know this as an FYI.
It does not seem like the letter reached the person to whom it was directed to.
did you emailed to ombudsman also? any replies from him?

Yes, I agree that not filing GC earlier is not an excuse for MBA. The point is he still would have been in the same situation (EB3, 2003 is not too different from EB2, 2005) in terms of how fast he will get his GC.
The law would allow him to port his EB3 PD just like how it is doing now. he will not be in the same situation, isn't this better now?

During the discussions on 1485 filing provisions we there were questions related to EB2, EB3 backlog numbers post 2007 july + Based on the recent information we got on pending numbers + our discussion on if EB2 will get current this year helps us understand how the last quarter will behave. This analysis is not official and is our own interpretation based on information we know. We do not wish to seek out specific information on visa bulletins. It has not been IV policy. VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter. how quick we are to blame the Indian Govt.......??
Continental has direct flights to Delhi and Mumbai from Newark, Jet flies from both JFK and Newark, Air India flies direct as well, American flies from Chicago direct.
Many Middle East airlines (Qatar, Emirates) fly from New York to their respective hubs in Middle East and then to multiple cities in India.
Aeroflot ( my parents had a great experience on the airline - good food, courteous service and good new boeing planes) flies to Moscow and then to India.
West Coast folks can fly via Singapore or HK or Malaysia........
With so many choices - why should we even bother to patronize the London airport - i have no idea.....
Though i have a GC and dont need a TV for london - i hate to patronize such unfriendly airport systems.

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.

Will this affect my GC process. I have no plans of buying a house in coming years.

Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.
Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.

is'nt this exactly what the investment bankers and speculators on wall street did? It was not illegal (since Paulson and Dubya have deregulated the market so much) but it has now led to the biggest economic downturn in decades, has decimated the retirement savings of millions, and led to millions losing their homes and jobs. Nothing illegal, good for the people who made those decisions (millions in bonuses) but absolutely disasterious for society as a whole.
The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....

Those who bought houses to flip, or mortgages that they cant afford blame the lenders, the housing market, alan greenspan etc. The CEOs of the Detroit big-3 earlier this week blamed the economy, california emission standards, fuel prices etc.
WHat has happened to taking responsibility for their own actions?? Of all the financial firms it is the one doing somewhat ok: Goldman Sachs, which has cancelled bonuses for their execs. All these other firms which came tincan in hand begging for taxpayer bailouts should all also, by default cancel all salaries and bonuses for the execs. But no, there is no taking of responsiblity any more. Any problem that anyone in America has, is someone else's fault. Disgusting.

We can raise the issue is that the govt does not want to address our plight as
1. We are not entitled to any benefits till we get our GC such as Social security, benefits etc though we pay taxes which inturn are used by US citizens
2. We contribute to the economy by buying goods etc so there is a dual intent to keep the foreigners here but not to give them GC/citizen ship asap

The spillover rules that changed in 2007 will ensure that those visas will first go to E1 -> EB2 and then fall to us if there is an overflow. To be specific L1B resources cannot be deployed in client premises on projects managed and controlled by client (known consulting assignments in technology world). This is just part of the violation. Second... L1B resources cannot be used for general technical skills (java/.net/oracle/production support etc) BUT can only be used for their speciality skills (while processing the L1 visa outsourcing companies shows some internal tools to prove this point). Hope this cleared your doubt, I am pretty sure that now you will be able to find a lot of violations in using L1B resources. L1B resource usage is so common that most of us who are aware of immigrations statuses even doesnt know about this .. forget others including our clients and their managers.
